By accessing or using the services provided by Be Underwater, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. User Accounts

Users may create accounts to access certain features of the services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

3. User-Generated Content

Users are allowed to upload images and other content to the platform. By uploading content, you grant Be Underwater a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content in connection with the services.

4. Feedback and Suggestions

We welcome feedback and suggestions regarding our services. You can contact us with your feedback, and we will consider your input to improve our services.

5. Intellectual Property

All content, trademarks, and other intellectual property associated with Be Underwater are the exclusive property of Be Underwater. You may not copy, modify, or distribute any materials without our express written permission.

6. Changes to the Terms

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date at the top of this document.

7. Payments and Fees

Some features of Be Underwater may require payments, such as subscription fees or transaction fees. By using our services, you agree to pay all applicable fees as outlined during the payment process. All payments are processed securely, and you will receive confirmation of your transaction.

7.1 Payment Methods

We accept a variety of payment methods, including credit cards, debit cards, and online payment services. By providing payment information, you represent that you have the legal right to use the chosen payment method.

7.2 Refunds

Be Underwater works with two main types of cancellation policy configured by the dive center for each experience:

  • Refundable listings: your card is authorized at the time of booking, and the payment is normally captured around one week before the course starts.
  • Non-refundable listings: for auto-approved bookings, the payment is captured immediately at the time of reservation.

For both types of listings, once the payment has been captured (whether at booking time or one week before the start date), the booking becomes non-refundable, except when a refund is required by law or granted at the sole discretion of Be Underwater or the dive center in exceptional circumstances.

9. Cancellations and Refunds

9.1 Dive Center Cancellations

If a dive center cancels a booking with less than one week's notice, they will be responsible for covering any applicable commission fees. These fees will not be refunded to the dive center, and the diver will receive a full refund for the canceled experience. This is to ensure that divers are not financially impacted by last-minute cancellations.

However, if the cancellation is due to unavoidable adverse conditions such as severe weather or other force majeure events, Be Underwater will cover the commission fees, ensuring the diver receives a full refund and dive center is not affected either. Dive centers must provide valid proof of the circumstances leading to the cancellation to qualify for this exception.

9.2 Diver Cancellations

When you book a course, your card is authorized at the time of booking. For refundable listings, the payment is normally captured around one week before the course start date. For non-refundable listings that are auto-approved, the payment may be captured immediately at the time of booking.

If you book a course that starts in less than one week, payment for both refundable and non-refundable listings may be captured immediately. In all cases, once the payment has been captured, the booking is treated as non-refundable, and no refund will be issued if you cancel, except where required by law or in exceptional cases decided by Be Underwater or the dive center.

If you need to reschedule, you should contact the dive center via chat. Rescheduling is not guaranteed and depends on the dive center's availability and policy.

9.3 No-shows

In the event of a no-show, where the diver does not attend their scheduled booking without prior cancellation, no refund will be issued. The dive center will still receive the payment, less the commission fees. This policy ensures that dive centers are compensated for reserving resources and maintaining readiness for scheduled dive experiences.

9.4 Liveaboard Cancellations

For many liveaboard bookings, cancellations are allowed up to two months before the departure date. If a cancellation is made after this period, no refund will be issued for those refundable liveaboard bookings.

Some liveaboard experiences may be configured by the operator as non-refundable, in which case the payment will not be refunded regardless of when the cancellation is made. Please always review the specific cancellation policy shown on the liveaboard listing and during checkout.

If exceptional circumstances prevent travel (such as severe weather or force majeure), Be Underwater may consider a refund or rescheduling at its discretion. Valid proof of the circumstances must be provided to qualify for this exception.
